Over the years, there have been many hash oil incidents that have led to serious injuries. In 2017, Eric Scully was sentenced to seven years in prison for setting a storage facility on fire when he was making butane hash oil.

One dispensary owner explained the legality of the production of hash oil.

“It’s totally illegal for the average citizen to use butane to extract cannabis and make BHO on their own,” said co-owner Travis MacKenzie at TJ’s Gardens.

MacKenzie said that in Oregon a person must be licensed by the OLCC as a recreational processor and licensed by the OHA as a medical processor.

“As a recreational customer, you can have one ounce or less in public," MacKenzie said. "At home you can have 8 ounces."

There are a variety of types of oil, but butane is extremely flammable. It becomes vapor at 32 degrees and will become explosive when reaching the atmosphere.

“Keep it to the ones that are safe,” MacKenzie said. “So you’re not endangering yourself, your family, your neighbors or your pets.”

MacKenzie encourages the public to look at different ways to make hash oil, such as an ice water extraction.

“YouTube has a lot of videos on how to make hash oil," MacKenzie said. "There’s a lot of resources out there to look and to find to try to make your own extractions that are safe.”
