Cottage Grove murder suspect claims father hit him first

Newly released court documents say Stanley Hicks was killed with a Louisville Slugger baseball bat.

COTTAGE GROVE, Ore. -- The man suspected of killing his father with a baseball bat in Cottage Grove says his father hit him first, according to newly released court documents.

Britton Hicks, 35, is accused of assaulting his father, Stanley Hicks, 69, on Aug. 26. He died two days later.

Court documents say Britton Hicks claimed he and his father had been fighting all day inside their townhouse on South 8th Street, and he said when they got back from a Eugene pool hall, they started arguing again.

He said his dad hit him in the head with a wooden Louisville Slugger baseball bat, according to court documents. Hicks reported that he took the bat from his father and hit him three times until he stopped moving, wanting to make sure his father would not retaliate.

Police said they did not observe any swelling where Britton Hicks said he was hit.

After the altercation, Hicks then decided to call 911, court documents said.

Officers said the scene of the crime indicated a large physical altercation had taken place in the kitchen before police arrived. Police said they found the glass door of the oven had been broken, but Britton Hicks said he didn’t know how the door broke and believed it to have been intact earlier in the day.

According to police, Hicks later told them he regretted what he did but said he “knew someday this would happen.” Hicks reported that his father had PTSD and memory issues, and his father accused him of saying and doing things he didn't do.

Britton Hicks was arraigned on one count of murder.

Court documents say that police in Cottage Grove are familiar with the home on South 8th Street due to a number of calls for service at the location.

Britton Hicks was arrested in December 2018 after an alleged altercation with Stanley Hicks on charges of assault and harassment, court documents say. Those charges were dropped in court.

The murder investigation is ongoing.
